1. Application of the Terms of Use and description of the service

Tomtoi Oy (“Service Provider”) is the owner and operator of the en.tomtoi.com web portal (the “Service”). By using the Service, you (“User” and/or “Business User”) agree to be bound by these Terms.

1.1 Service description
The Service operates as an online service that allows registered users to make their own notifications through the Service. Users can also contact the Notices that interest them.

Contracts on the Service are entered into between Users and agreed upon by them on separately agreed terms. The Service Provider is in no way a party to or responsible for the agreements. All parties to the agreement are responsible for their own obligations and liabilities.

1.2 Registering for the service
Some features of the Service are only available to registered users.

Any individual, company or entity that has accepted the Terms of Service may register as a User of our Service. The User declares that the information provided by him/her is up-to-date and correct. The User undertakes not to use the identity of another person, company or representative of a company.

When registering for the Service, the User shall specify a user name (“User ID”) and password, and indicate his or her chosen role as a User of the Service. The User ID effectively corresponds to the User’s email address. It is of paramount importance that the User carefully safeguards his/her password so that it does not accidentally fall into the possession of a third party without the User’s consent. The user takes full responsibility for his/her username.

You are granted the right to use the Service provided that you comply with these Terms of Use and other rules and guidelines relating to the Service. When registering, the User shall provide the necessary registration data (hereinafter “User Data”), which will allow the User to be identified and identified and to choose a password-protected User ID for use of the Service. Providing false User Data is a violation.

The Business User registering for the Service must be entitled to act as a representative of the company in the capacity of User. Only one ID per User is allowed. In case of misuse of the User’s IDs, the User shall immediately notify the Service administrator ([email protected]).

The Service Provider will process the personal data of Data Subjects’ Users in accordance with the Service’s Privacy Statement, Data Protection Statement and privacy legislation. (Link to Privacy Policy)

1.3 Use of the Service
The Service Provider is not responsible for any material submitted to the Service, User messages or other actions on the Service.

The User is responsible for the material submitted and its content. The material and its content submitted by the User must be in appropriate language and conform to common good practice. The User undertakes to ensure that the material does not interfere with information systems or infringe the rights of third parties, such as copyright or privacy. If the Service Provider, a public authority or a third party discovers or suspects a breach of the rules, they have the right to remove the material or block its use without prior warning to the User.

1.4 Data storage

The Service Provider, in its role as data controller, stores the data provided by the User. The data of registered Users will be stored in the register of the Service. For details of what data is stored by the Service Provider and for what purposes it is processed, please refer to the Service’s Privacy Policy. The data will be stored and processed in accordance with the applicable personal data legislation and the Service’s Privacy Statement. This Service is not intended for long-term storage of data or other information. It is the User’s responsibility to back up all material and data uploaded or stored on the Service. 2. Payment and fees

Registration for the Service is free, but there is a fee for submitting a notification and any additional services. The price list for the Service will be announced separately, and will set out the prices and conditions for the fee-based services.

The Provider may also change the pricing and billing criteria for the Service by posting the changes on the Service or by any other appropriate means. If taxes or public charges change, prices may change accordingly.

In the Service, the visibility of the Notification is a monthly paid feature, and in addition, the User may purchase additional services on a one-time fee basis. Fees are automatically charged to the Customer unless he/she wishes to terminate the Contract for the Notice. The termination period is one (1) month.

2.1 Payment methods

Payment methods are direct debit and e-invoicing. Payment methods, payment terms and prices are displayed on the Service.

3. Rights of the service provider

The Service Provider has the right to modify, add and remove parts of the Service, to change free parts of the Service into paid parts or to terminate the Service partially or completely.

The Service Provider has the right to use the User’s e-mail address for the purpose of developing the Service and to send the User notifications and marketing messages concerning the Service.

The Service Provider has the right to use the User’s Notification for its own marketing. The Service is available 24 hours a day, 7 days a week (24/7), but the Service Provider reserves the right to carry out, for example, maintenance work, if necessary, which may result in the Service being temporarily unavailable. Such interruptions will be communicated on the Service’s website. The Service Provider shall not be liable for any interruptions to the Service caused by, for example, technical faults or other similar factors beyond the control of the Service Provider.

The Service Provider shall retain all rights not expressly granted to the User in these Terms of Use.

4. Validity of the Terms of Use

The Terms of Service are valid until further notice. The Service Provider may also suspend or terminate the provision of the Service to the User for legitimate reasons, such as cases of misuse. The User has the right to delete his/her own notification.

The Service Provider may unilaterally update these Terms of Use on its website by posting changes on the website. The User accepts the changes by continuing to use the Service.

The Terms of Use are valid indefinitely from 2.1.2024.

5. Cookies

The Service uses cookies to improve the user experience, analyze site traffic and provide customized content. By using the Service, you agree to the use of cookies. You can control your cookie settings in your browser preferences and, if necessary, refuse the use of cookies, but this may affect the functionality of the Service. 6. Disputes and the law

The Service and these Terms of Use are governed by Finnish law. Disputes shall be settled primarily by negotiation and without unanimous result, in Helsinki District Court.
